At Esmée, we take data protection seriously. In this declaration, we inform you transparently and in plain language about what data we process, for what purpose, and on what legal basis.

This Privacy Policy applies to the processing of personal data via the website esmee.ch and related services. The relevant laws are the Swiss Federal Act on Data Protection (FADP, effective since September 1, 2023) and – where applicable – the EU General Data Protection Regulation (GDPR) for visitors from the EU/EEA and the UK.

Personal data refers to all information relating to an identified or identifiable natural person (e.g., name, address, email, IP address).

3. What Data We Collect

3.1 Data You Actively Submit to Us

When you place an order with us, create an account, subscribe to our newsletter, or contact us, we process the following, in particular:

  • First and last name
  • Delivery and billing address
  • Email address
  • Phone number (if provided)
  • Order content and history
  • Payment information (see Section 9)
  • Communication with our customer service

3.2 Data Collected Automatically

When you visit our website, the following technical data is automatically collected:

  • IP address (truncated, where technically possible)
  • Date and time of access
  • Browser type and version
  • Operating system used
  • Referrer URL
  • Pages visited

This data is necessary to deliver our website and operate it stably.

4. Purposes and Legal Bases

We process your data for the following purposes:

  • Order processing: delivery, payment processing, communication
  • Customer account: managing your account (if created)
  • Communication: answering inquiries
  • Marketing: newsletters, personalized advertising, success measurement (each with your consent)
  • Website operation: display, functionality, security, optimization
  • Legal obligations: accounting, tax and data protection law

The legal bases include, in particular:

  • Contract fulfillment (orders, customer account)
  • Legitimate interest (website operation, security, direct marketing to existing customers)
  • Consent (newsletter, tracking, marketing cookies)
  • Legal obligation (accounting according to Art. 958f CO)

5. Cookies and Tracking Technologies

5.1 What are Cookies?

Cookies are small text files that your browser stores when you visit our website. Some are technically necessary (e.g., for your shopping cart to function), others help us improve the experience or display more targeted advertising.

5.2 Cookie Consents and Cookie Banner

For managing cookie consents, we use Shopify's native cookie banner (Shopify International Limited, Dublin, Ireland – see also Section 11).

Shopify automatically detects the region from which you visit our website and displays the cookie banner only where explicit consent is legally required (especially EU/EEA and the UK).

For visitors from Switzerland, an opt-out model applies according to Art. 45c lit. b FMG: cookies and tracking tools are loaded by default when you visit. No cookie banner is displayed. You can object to processing at any time – we explain how in Section 5.3.

For visitors from the EU/EEA and the UK, non-essential cookies are only set after your consent via the cookie banner. You can adjust or withdraw your selection at any time. Additionally, you can exercise your rights under the GDPR by emailing info@marein.ch.

5.3 How to Manage Your Cookie Settings

You can restrict processing by cookies and tracking tools at any time. There are several ways:

6. Web Analytics and Marketing Tools

The following tools are loaded by default when you visit. You can object to processing at any time via our cookie banner or the corresponding link in the footer.

6.1 Google Analytics 4 (GA4)

Provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (for visitors from the EU/EEA) and Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

GA4 helps us understand how our website is used. Data collected includes IP address (truncated), page views, device information, and time spent on site. Transfer to the USA is possible.

6.2 Google Ads and Google Tag Manager

Provider: as 6.1.

We use Google Ads to draw attention to our products and measure the success of our advertisements. Google Tag Manager organizes the loading of other tracking tools on our website.

6.3 Meta Pixel (Facebook/Instagram)

Provider: Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland; Meta Platforms, Inc., 1 Hacker Way, Menlo Park, CA 94025, USA.

Through the Meta Pixel, we can target advertising on Facebook and Instagram more effectively and measure its success. Data processed includes IP address, browser information, pages visited, and actions (e.g., "product viewed," "added to cart").

6.4 Pinterest Tag

Provider: Pinterest Europe Ltd., Palmerston House, 2nd Floor, Fenian Street, Dublin 2, Ireland.

We use the Pinterest Tag to measure the success of advertising on Pinterest. Data collected includes IP address, browser information, and conversion data.

6.5 YouTube Videos

Provider: Google Ireland Limited / Google LLC (see 6.1).

YouTube videos may be embedded on our website. When played, data is transmitted to YouTube (including IP address, device information, and potentially cookies if you are logged into Google). We use – where technically possible – the enhanced privacy mode.

7. Newsletter and Email Marketing (Mailchimp)

For sending our newsletter and transactional emails, we use Mailchimp (The Rocket Science Group LLC d/b/a Mailchimp, 405 N Angier Ave. NE, Atlanta, GA 30308, USA – an Intuit Group company).

The following data is processed:

  • Email address
  • First and last name (if provided)
  • Order history and interactions (e.g., whether you opened an email)
  • Web behavior on our website (with your consent)

The newsletter is only sent if you have actively subscribed (double opt-in). You can unsubscribe at any time via the link at the end of each email. Data is transferred to the USA; Mailchimp is certified under the EU-U.S. Data Privacy Framework and the Swiss-U.S. Data Privacy Framework and additionally commits to complying with EU standard contractual clauses.

8. Reviews (Judge.me)

For collecting and displaying product reviews, we use Judge.me (Webionic Ltd., Hong Kong).

After an order, you will receive an email asking you to review the product. Your name (or pseudonym), email address, order information, and your review are processed. Only the review and – if you choose – your first name will be published.

9. Payment Processing

Depending on your selection at checkout, your payment data will be transmitted to the following service providers:

9.1 Shopify Payments (including TWINT, credit cards, Apple Pay, Google Pay)

Provider: Shopify International Limited, 2nd Floor Victoria Buildings, 1-2 Haddington Road, Dublin 4, Ireland.

When paying by credit card or TWINT, payment data is processed directly by Shopify. We ourselves do not receive full card details.

9.2 Klarna

Provider: Klarna Bank AB (publ), Sveavägen 46, 11134 Stockholm, Sweden.

If you select a Klarna payment method, your data will be transmitted to Klarna. Klarna may conduct a credit and identity check.

9.3 PowerPay – Purchase on Invoice (via PEND)

Provider: MF Group AG, Bahnhofstrasse 21, 6300 Zug, Switzerland, in cooperation with PEND AG, Switzerland.

If you select "Purchase on Invoice," your data will be transmitted to MF Group. MF Group conducts a credit check and handles invoice processing and dunning.

10. Shipping

For shipping your order, we transmit the necessary data (name, delivery address, phone number, email for shipment notifications) to our shipping partners:

11. Shopify as Shop System

Our website is hosted and operated using Shopify (Shopify International Limited, Dublin, Ireland; Shopify Inc., 150 Elgin Street, Suite 800, Ottawa, ON K2P 1L4, Canada).

Shopify processes all data that you enter on our website or that arises during the ordering process on behalf of Marein AG. Transfer to countries outside the EU/EEA (especially Canada and the USA) is possible. Shopify is certified under the EU-US Data Privacy Framework and additionally uses standard contractual clauses.

12. Other Apps and Services

Further Shopify apps are used on our website:

  • Kaching CartDrawer + Bundles: Displays and manages the shopping cart and provides bundle/upsell functions. Primarily processes anonymized shopping cart and session data.
  • SA Variants: Displays product variants. Does not process any personal data.

13. Data Transfer to Third Countries

Some of our service providers are based or have their servers outside Switzerland and the EU – particularly in the USA, Canada, and Hong Kong (Judge.me).

These transfers are made on the basis of:

  • EU standard contractual clauses
  • EU-US Data Privacy Framework (where certified)
  • Your explicit consent (e.g., for marketing cookies)

We carefully select our service providers and ensure an adequate level of data protection.

14. Storage Duration

We store personal data only for as long as necessary for the respective purpose or as required by law:

  • Customer account and order data: 10 years (Swiss retention obligation according to Art. 958f CO)
  • Newsletter data: until unsubscribe
  • Contact inquiries: up to 2 years after completion
  • Tracking and analysis data: usually 14 months (GA4 standard), varies depending on the tool
  • Server logs: maximum 30 days

15. Your Rights

You have the right at any time to:

  • Information about what data we process about you
  • Rectification of inaccurate data
  • Erasure of your data (unless there is a legal retention obligation)
  • Restriction of processing
  • Data portability (provision in a common format)
  • Objection to certain processing activities
  • Withdrawal of given consents with effect for the future

To exercise your rights, simply send us an email to info@marein.ch. We usually respond within 14 days.

If you believe that we are not processing your data correctly, you can also contact the competent supervisory authority:

16. Data Security

We take technical and organizational measures to protect your data against loss, manipulation, and unauthorized access. These include, in particular, SSL/TLS encryption, access restrictions, regular updates, and secure hosting infrastructure.

Despite all due care, 100% security for data transmission over the internet is not possible. You therefore transmit data at your own risk.

17. Changes to this Declaration

We reserve the right to adapt this Privacy Policy if laws, our service providers, or our processes change. The version currently published on esmee.ch is authoritative.
